To address and resolve disputes between users and DigiDynasty, the following steps
should be taken:
Formal Complaint
Submit a Formal Complaint: If the issue is not resolved through
informal resolution, users may submit a formal complaint in writing. The
complaint should be sent to support@yhedigidynasty.com and must
include a description of the dispute, any supporting evidence, and the desired
resolution.
Review and Response
Acknowledgment: Digi Dynasty will acknowledge receipt of
the formal complaint within 5-7 business days
and will provide an estimated time frame for resolution.
Investigation: The complaint will be investigated by
relevant personnel. Digi Dynasty will provide a written response addressing
the complaint within 7 business days.
Escalation
Escalation to Management: If the complaint is not resolved to
the user's satisfaction, the matter may be escalated to senior management
for further review and resolution.
Final Decision: A final decision will be communicated to
the user in writing, including any actions taken or proposed resolutions
.
External Mediation:
Seek Mediation: If the dispute remains unresolved after
following the above steps, users may seek mediation through a third-party
mediator. Mediation is voluntary and involves a neutral third party
assisting in reaching a mutually acceptable resolution.
Arbitration Clauses and Jurisdiction
If a dispute cannot be resolved through the internal dispute resolution
process or mediation, the following arbitration clauses and jurisdiction
terms apply:
Arbitration Clause
Mandatory Arbitration: Any disputes, claims, or
controversies arising out of or related to the use of Digi Dynasty’s
services or these terms of service that cannot be resolved through
mediation shall be resolved through binding arbitration.
Arbitration Rules: The arbitration shall be conducted
under the rules of the American Arbitration Association (AAA)] in effect
at the time of the dispute.
Arbitration Costs:strong> The costs of arbitration
shall be shared equally between the parties unless otherwise determined
by the arbitrator. Each party shall bear its legal fees and costs.
Jurisdiction and Venue
Governing Law: These terms and any disputes arising out of
or related to them shall be governed by and construed under the laws of
Florida, without regard to its conflict of law principles.
Jurisdiction: The state or federal courts located in
Florida shall have exclusive jurisdiction over any legal actions not
subject to arbitration.
